First Lawsuit Filed Against Kaiser Permanente After Numerous Survivors of Dr. Michael Wilmington Come Forward

SEATTLE, Wash. (May 11, 2026) — Attorneys at Pfau Cochran Vertetis Amala PLLC (PCVA Law) today filed the first lawsuit on behalf of a former patient of Dr. Michael Wilmington against Kaiser Permanente, alleging it knew of the danger Dr. Wilmington presented to its pediatric patients, but failed to protect them.

In the past several days, numerous survivors have come forward alleging sexual abuse by former Clark County pediatrician Dr. Michael Wilmington, who was under criminal investigation related to child sexual abuse allegations and possession of child pornography. Earlier this month, Dr. Wilmington died from suspected suicide.

First Lawsuit Filed against Washington Healthcare Provider Kaiser Permanente on Behalf of a Victim of Sexual Abuse by Pediatrician Dr. Michael WIlmington

According to attorneys at PCVA Law, survivors describe a consistent pattern of inappropriate conduct occurring during medical appointments and examinations over decades, much of which occurred in front of, or was reported to, other medical providers.

Recently released court documents related to the criminal investigation contain additional allegations involving sexual misconduct with minors and the discovery of pornographic images involving children at Wilmington’s residence.

The survivor who filed her lawsuit today under a Jane Doe pseudonym alleges Wilmington conducted medically inappropriate genital and breast examinations without gloves or a chaperone present, required unnecessary nudity during examinations, exposed her to sexually explicit material, and made repeated comments encouraging nudity.

PCVA Law says that they have not only heard from dozens of survivors of Dr. Wilmington, but have also heard from numerous parents and medical staff who reported his misconduct over the years to Kaiser. These reports were clearly ignored.

For example, one parent reportedly notified Kaiser Permanente staff several years ago that Wilmington repeatedly invited children to his home and that the behavior appeared inappropriate. In another instance, approximately three years ago, the guardian of a minor patient allegedly reported concerns to Kaiser Permanente management after Wilmington made inappropriate comments during an examination that caused the child significant discomfort.  Nearly twenty years ago, another parent reported that Dr. Wilmington had done an inappropriate and invasive sports physical on her daughter.

“I trusted Dr. Wilmington and the institutions that employed him to keep me safe. To hear that complaints were met with inaction is devastating,” said Jane Doe, the plaintiff whose lawsuit was filed today. “I hope this lawsuit shines light onto why reports were ignored, and helps ensure that no one else is harmed the way I was.”

“We are seeing a pattern of institutions ignoring serious complaints that put their patients at risk,” said Mallory Allen, partner at PCVA Law. “We want to know exactly what institutions knew, when they knew it, and whether appropriate action was taken to protect children because these families deserve answers.”
