Tom Vertetis, Elizabeth Calora and William McClure reached a $3.5 million settlement with Pierce County on behalf of the estate of an accident victim who was struck and killed by a police vehicle driven by a sheriff’s deputy.
Sheriff Deputy Eric Lopez was traveling on the wrong side of a double yellow line at approximately 81 mph when he struck the plaintiff’s vehicle. The deputy’s foot was “100% on the gas pedal,” according to the investigation completed by the highway patrol. The speed limit where the accident occurred is 35 mph, and the area is known to be congested with vehicles and pedestrians.
“The crash was simply tragic and avoidable if proper protocols had been followed,” said Tom. “The settlement brings stability and closure to three grieving children who will grow up without a mother.”
The settlement is for the sole benefit of the three minor children. Sean Wickens served an important role as co-counsel in the case.
