Blasco v. El Gaucho Tacoma, LLC, et al. – $1.5M Settlement

About the case

Former and then-current employees of El Gaucho restaurants filed this class action lawsuit over multiple practices violating Washington wage-and-hour laws, including: requiring employees to clock in late or clock out early in order to avoid paying overtime; failing to pay employees for missed meal and rest breaks; failing to pay employees in compliance with Washington automatic service charge laws; and management taking a portion of front and back-of-house employees’ tip pool earnings.  After extensive litigation, El Gaucho agreed to a $1.5 million class action settlement and a judicially-enforceable promise to comply with all statutes and regulations regarding automatic service charges.
